This page is the starting point of every matter in our office. By completing the online application, you provide our office with the information we need to assess whether a section 21 application for a postnuptial contract is appropriate in your circumstances.
By submitting this application, you provide personal information for the purposes of assessing your enquiry and any legal instruction that may follow. Your information will be processed in accordance with our Privacy Policy and POPIA Notice. Completing the form does not create an attorney-client relationship and does not guarantee the success of any application that may follow.
What to have ready
- Both spouses’ identity numbers, occupations, employers, residential addresses and email addresses.
- The date and place of your marriage. If you concluded a customary marriage before a civil ceremony, the date of the customary marriage as well.
- A summary of your assets (immovable property, vehicles, bank accounts, investments, business interests).
- A list of your creditors with addresses and amounts outstanding.
- A clear sense of the regime you wish to move to: out of community of property with the accrual system, or without it.
You do not need to attach copies of every document at the application stage. The application is a structured intake; documents are collected after the assessment.

What happens after you submit
- Acknowledgement — an automated acknowledgement is sent.
- Assessment — within three to seven working days, our office reviews the application.
- Response — we respond with our view, the issues to be considered, and a fee proposal.
- Engagement — if you wish to proceed, you sign the engagement letter.
- Drafting — we begin the drafting and the rest of the process.
A note on consent
A section 21 application is brought jointly by both spouses. Submitting the form on behalf of yourself alone, without your spouse’s knowledge and consent, is not a sound basis for proceeding. Where this becomes apparent during the assessment, we will indicate that the application cannot proceed until both spouses have signed the firm’s engagement letter and confirmed their consent.
