Postnuptial Contracts for Johannesburg Couples

Couples living in Johannesburg or the broader Gauteng Local Division area instruct our office regularly for section 21 applications. The matter is brought in the High Court that has jurisdiction over the spouses. Depending on where you are domiciled, the matter may be heard in the Gauteng Local Division (Johannesburg) or in the Gauteng Provincial Division (Pretoria). Our office advises on which Division applies to your matter at the assessment stage.

How a Johannesburg matter typically works

For a couple living in Johannesburg, the matter typically proceeds as follows:

  1. The online application is completed.
  2. Our office assesses the matter and issues an assessment letter.
  3. The consultation is conducted at our office in Pretoria, or by video call.
  4. Documents are exchanged by post, courier and secure digital channels.
  5. The application papers are drafted, signed by the deponents before a Commissioner of Oaths near them in Johannesburg, and returned to our office.
  6. The matter is set down in the relevant Division.
  7. The notarial signing is held at our office in Pretoria, or — by arrangement — in Johannesburg.
  8. Lodgement at the Deeds Registry is handled by our office.

The geographical distance between Johannesburg and Pretoria is not a material obstacle. Most of the matter is conducted remotely. The notarial signing is the one step that requires the spouses to attend in person at the Notary Public.
