Our office is based in Pretoria and acts for couples across South Africa. The bulk of a section 21 matter can be handled remotely. The online application is the entry point; documents are exchanged by post and secure digital channels; affidavits are signed before a Commissioner of Oaths near you; the court application is brought in the High Court that has jurisdiction over the spouses; and the registration is handled at the Deeds Office.
What is location-sensitive
The two location-sensitive elements are:
- The court. The application is brought in the High Court that has jurisdiction over the spouses. For most matters our office issues in the Gauteng Provincial Division, Pretoria, but where another Division is appropriate we make the arrangements.
- The notarial signing. The signing of the notarial postnuptial contract requires both spouses to attend at the Notary Public in person. The default is that the signing is held at our office in Pretoria. We can, by arrangement, make alternative arrangements for clients who cannot travel to Pretoria.
Everything else — the assessment, the drafting, the consultation, the creditor notice, the lodgement at the Deeds Office — is handled by our office.
Who we act for
We act regularly for couples in Pretoria, Johannesburg, the broader Gauteng Province, and other South African provinces. Where the matter has a foreign element — for example, where one spouse is not domiciled in South Africa, or where the marriage was concluded outside South Africa — the assessment is more involved and we say so candidly.
Working with us remotely
- Documents. Most documents are uploaded through the online application or shared by secure digital channel. Originals (for example certified ID copies) can be posted or couriered.
- Affidavits. The founding and confirmatory affidavits are signed before a Commissioner of Oaths. Most attorneys, notaries and police officers can administer the oath. We send you finalised affidavits for signature and you return signed originals.
- Communication. Email and telephone are the main channels. We also do video consultations on request.
