HOW WE APPROACH THE WORK

Postnuptial matters are document-heavy and procedurally specific. Our approach reflects that:

Assessment first. Every enquiry begins with an assessment of whether a section 21 application is appropriate. We tell clients candidly when it is not, and where appropriate, what alternative might be.

Document-driven process. Our online application is structured around the information the court will eventually need. From the first intake forward, every document and every averment has a defined purpose in the bundle.

Firm-house clauses. Every order, every notarial contract and every Notice of Motion in our office contains the mandatory creditor-protection clause — identical in all three documents — and the prospective-only commencement clause. Both are non-negotiable firm rules.

Conservative, supportable averments. The founding affidavits are built on supportable, fact-specific reasons. We do not exaggerate motive or overstate exposure.

SA spelling, SA tone. All firm output is in South African (UK) English. The pleadings are in the conservative, respectful register that the High Court expects.

GEOGRAPHIC COVERAGE

Our office is in Pretoria. The Gauteng Division, Pretoria is our primary court for section 21 applications. We act for clients across South Africa: documents can be exchanged by post, courier and secure digital channels, and the notarial signing is the only step that requires physical attendance by the spouses (typically at our office in Pretoria).
